( 01 ) PURPOSE

This Privacy Statement (“Privacy Statement”) explains how Arketype, a private company with limited liability organised under the laws of India, processes your personal data when you:

  • browse or use the Arketype website or other online services that reference this Privacy Statement (collectively, the “Site”), or

  • interact professionally with Arketype, apply for a creative collaboration on our careers page, apply to start a project on our partnerships or contact page, or communicate or otherwise deal with us (collectively, “Professional Interactions”).

This Privacy Statement is aligned with the EU General Data Protection Regulation (“GDPR”), which serves as the global benchmark that governs global processing of personal data. This means that we apply GDPR-level data protection standards globally regardless of your country of location. Whether you are in India, the European Economic Area (EEA), the United States (US), the United Kingdom (UK), Australia, the Asia-Pacific region, or any other region, our approach to data protection and privacy is the same, unless a local exception may be applicable.

( 02 ) WHO IS THE CONTROLLER?

When you access and use the Site either as a visitor, business prospect, client, or job candidate, Arketype is the data controller. A “controller”, under GDPR, is a person or organisation who alone or jointly determines the purposes for which, and the manner in which, any personal data is, or is likely to be, processed.

( 03 ) IMPORTANCE OF PRIVACY

We recognize that the processing of personal data has important implications for us as well as for the individuals whose personal data we process. In order to make sure you are aware and informed of how we handle personal data properly at Arketype, we have adopted this Privacy Statement to ensure privacy compliance.
 

This Privacy Statement is intended to describe our overall privacy and data protection practices insofar as processing your data via our Site and during Professional Interactions are concerned. In some cases, different or additional notices about our data collection and processing practices may be provided and apply to our processing of certain personal information.
 

It is important that you read this Privacy Statement together with any other notices, policies and/or statements we may provide on specific occasions when we are collecting or processing your personal data (i.e. if you as a job candidate become an employee or if you as a prospect become a client where data processing is involved), so that you are fully aware of how and why we are using your personal data. This Privacy Statement supplements the other notices, policies and/or statements and is not intended to override them.

( 04 ) WHAT PERSONAL DATA DO WE PROCESS?

Personal data includes any information relating to an identified or identifiable natural person. It does not include data that cannot be linked to an individual (anonymous data).
 

Special categories of personal data include details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data. Arketype does not ordinarily process special categories of data via its Site or through Professional Interactions.
 

Please see below which categories of personal data we process through your use of the Site or via Professional Interactions:

  • Contact and enquiry submission data, such as your first name, last name, company, email address, country, and if applicable, any personal data that may be included in any query you submit, for new business, vacancy or other enquiries.

  • Candidate identification data, such as your full name, address, phone number, country of location, CV details and any supporting documentation or information you submit during your job application.

  • Usage data, which means the information about your use of our Site, our electronic portals and platforms, as well as our local area networking facilities (including WiFi) and similar electronic services, such as interactions with our mobile applications, information collected progressively when you visit our Site, electronic portals and platforms, pages you visit, actions you take, information on last viewed/visited Site and details of the content viewed including when and how many times the content was viewed, patterns of page visits, time details per visits (e.g. visit duration, number of visits, time spent on each page, frequency of visits), details about the path followed with special reference to the sequence of pages visited, interactions, functionalities and modules used.

  • Technical data, meaning technical information collected when you access our Site, our electronic portals and platforms which we offer or which we have agreed with you to use, including your internet protocol (IP) address or domain names of the devices utilized, your login data, browser type and version, uniform resource identifier (URI) address, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you are using. Such data points are directly stored by the Site as first-party cookies, which enable us to collect analytics data, remember language settings, measure traffic and engagement, and perform other useful functions to improve your experience of our Site.
     

​Please note that we may also process and use aggregate, anonymous and de-identified data in order to assess, improve and develop our Site and Professional Interactions, or for similar research and analytics purposes. These aggregate, anonymous and de-identified data are not generally subject to the restrictions in this Privacy Statement, provided that it does not identify and could not be used to identify a particular individual.

( 05 ) HOW DO WE PROCESS YOUR PERSONAL DATA?

We use different methods to collect and process personal data, including through the channels set out below.
 

A. Your Enquiries

By filling in forms on our Site, or contacting us through our electronic portals and platforms, by email or post, by speaking to us in person or over the telephone, you may give us personal data in relation to your enquiry.
 

We use this information to carry out the following:

  • In line with the legitimate interest we have in promoting our business, we will process your enquiries to provide you with information about the services we offer, including replying to your enquiry or forwarding you a requested white paper.

  • We use Wix to process your email address and information supplied by you in the course of an enquiry through the Site where you may be identified as a lead or prospect as permitted under our legitimate interest to carry out commercial prospecting.

  • We may also process enquiries to take steps you ask of us with a view to entering into an agreement to provide you with our services. You are under no obligation to provide us with any details, but if you don’t provide all relevant information, we may not be able to help you.


​All content you submit to us

  • If you send us objectionable content or otherwise behave in a disruptive manner when using our Site, we may process personal data included in your messages to respond to and stop such behaviour.
     

B. How you use our website (analytics)

Our website uses cookies and other mechanisms to collect log and analytical information, such as your internet protocol (IP) address, to help analyse how visitors use the site and to compile statistical reports on website activity.

  • We process this information to understand how visitors use our website and to compile statistical reports regarding that activity (for example your IP address is used to approximate the country from which you access our website, and we aggregate this information together, so we know that, for example, most of the visitors to our website come from a certain country/area). Through the use of GA4, IP anonymization is enabled by default and cannot be switched off. This means that GA4 will not store the IP addresses of users and cannot track users. We also use Google Consent Mode, which is a privacy feature that allows modifying the behaviour of Google tags on our website based on the user’s consent preferences. With the GA4 consent implementation, GA4 is instructed to track users’ behaviour according to your consent preferences.

  • This processing is necessary for us to pursue our legitimate interests in improving our website, by enhancing the user experience and making the website as personal and relevant as possible. Cookie preferences can be changed via our website, however, disabling certain non-essential cookies may prevent you from taking full advantage of our services.   • This information is not used to develop a personal profile of you. All such information is aggregated and stored anonymously

C. Publicly available sources

We may, from time to time, where necessary and if applicable, collect personal data from publicly available commercial and professional sources, including from industry directories, business registers, and professional networking platforms like LinkedIn and other services accessible from the internet where you’ve shared information for business or networking purposes. We use this data to identify potential clients, partners, or leads relevant to our business activities.

( 06 ) WHY DO WE PROCESS YOUR PERSONAL DATA?

We will only process (i.e. collect, use, store and transfer) your personal data when the law allows us to, meaning when we have a legal basis for processing.

We use your personal data in the following circumstances:

  • The performance of a contract, i.e. when we need to perform a contract which we are about to enter into or already have entered into with you as a party or to take steps at your request before entering into such a contract;

  • Where we need to comply with a legal or regulatory obligation that we are subject to;

  • Where you have provided your consent to processing your personal data; or

  • Where necessary for our legitimate interests, provided that your fundamental rights do not override our legitimate interests, such as:

  • Performance of contracts with clients and other parties;

  • Improving our Site, services, developing reports, customer relationship management, marketing and analytics;

  • Fraud detection and prevention;

  • Physical / IT / network perimeter security

( 08 ) YOUR RIGHTS IN RELATION TO PERSONAL DATA

You have the following rights over the way we process personal data relating to you:

  • Right to be informed – You have a right to be informed about how we will use and share your personal data, and to request a copy of the data we are processing about you.

  • Right to access – you have a right to obtain confirmation of whether we are processing your personal data, access to your personal data and information regarding how your personal data is being used by us.

  • Rectification of inaccurate data – You have a right to have any inaccurate or incomplete personal data rectified.

  • Right to erasure and right to be forgotten – You have a right to request that certain personal data held by us is erased. The right to be forgotten is the right to have public data deleted. This may also include a request to restrict the use of or to stop processing your personal data.

  • Right to restrict processing in certain circumstances – You have a right to block the processing of your personal data in certain circumstances. This right arises if you are disputing the accuracy of personal data, if you have raised an objection to processing, if processing of personal data is unlawful and you oppose erasure and request restriction instead or if the personal data no longer is required by us but you require the personal data to be retained to establish, exercise or defend a legal claim.

  • Data portability – You can request a machine-readable copy of your personal data, which you can use with another service provider, also known as the right to data portability. Where it is technically feasible, you can ask us to send this information directly to another provider if you prefer.

  • Right not to be subject to automated decisions – You have a right not to be subject to a decision which is based on automated processing where the decision will produce a legal effect or a similarly significant effect on you.

  • Right to object – You can make a complaint to us, or to your local data protection authority. You may raise your concerns with your local data protection authority directly, but we would encourage you to contact us in the first instance as we aim to promptly, efficiently and satisfactorily resolve any concerns or complaints you may have in relation to our processing of your personal data.

  • Right to withdraw your consent – if we have your consent, the GDPR (if applicable) and other applicable data protection laws give you the right to withdraw your consent. You can do this at any time by contacting us.

  • We aim to comply without undue delay, and within one calendar month at the latest. Occasionally it may take us longer than one calendar month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated. Children

We do not use the Site to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at hello@arketype.in. We will delete such information within a reasonable time.

Security

We will take all reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal data. Our Site is hosted on a platform with adequate security measures and stores your data securely.
